1. Acceptance of Terms
By creating an account or using the Hindsight service ("the Service"), you agree to these Terms of Service ("the Terms"). If you do not agree, do not use the Service.
2. Description of the Service
Hindsight is a personal todo application offering: a Today view, multi-list organization, AI-generated aggregation suggestions on eligible plans, multi-device synchronization, data export, and account deletion. The Service is provided through a web interface and an Android application.
3. Your Account
You are responsible for maintaining the confidentiality of your Google sign-in credentials. Your account is personal and non-transferable. You must be at least 13 years old to use the Service.
4. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to disrupt, overload, or compromise the Service; (c) send unsolicited commercial messages through the Service; (d) reverse-engineer, decompile, or attempt to extract source code; (e) use automated tools to access the Service except for the documented public API; (f) infringe the rights of any third party.
5. Your Content
You retain full ownership of the content you create in the Service (tasks, lists, checklists, etc.). By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to store, process, transmit, display, and synchronize this content solely for the purpose of operating the Service for you, including generating AI-powered suggestions when you are on an eligible plan.
6. Plans and Features
The Service offers three plans: FREE (free, with core todo features), PREMIUM (paid, with additional features), and PREMIUM_AI (paid, with all features including AI aggregation suggestions). We reserve the right to change the features included in each plan with 30 days' notice. Features and pricing details are described in the app and on our website.
7. Payments
Paid plans are not yet activated. When activated: subscription fees are billed in advance on a monthly or annual basis depending on your selection; you may cancel at any time and your subscription will continue until the end of the current period; we do not offer pro-rated refunds for the unused portion of a billing period.
8. Generative AI Features
On PREMIUM_AI plans, we use a third-party large language model (Anthropic via AWS Bedrock) to generate aggregation suggestions based on your task and list content. AI-generated output may be inaccurate, incomplete, or unsuitable for your situation. You are responsible for reviewing each suggestion before applying it. We do not provide your content to model providers for training purposes.
9. Service Availability
We provide the Service on a best-effort basis without a contractual service-level agreement (SLA). Brief planned maintenance windows may cause temporary unavailability. For prolonged outages, we will notify users via email or in-app banner.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your specific requirements.
11. Limitation of Liability
To the maximum extent permitted by applicable law, our aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) BRL 100.00 or (b) the total amount you paid to us during the twelve months preceding the claim. This limitation does not apply where it is prohibited by mandatory law (including the Brazilian Consumer Defense Code, which protects consumer relations).
12. Indemnification
You agree to indemnify and hold us harmless from any claims arising out of your misuse of the Service or your violation of these Terms or third-party rights.
13. Suspension and Termination
We may suspend or terminate your account if you violate these Terms or applicable law. Where reasonable, we will provide prior notice. You may terminate your account at any time via Settings → Delete account.
14. Backups and Data Loss
We maintain periodic backups of the Service infrastructure for disaster recovery purposes. We are not responsible for restoring data that you intentionally deleted (cascade-delete after the 30-day account-deletion recovery window).
15. Changes to the Service
We may add, modify, or remove features at our discretion. For changes that materially affect functionality you rely on, we will provide 30 days' notice. For minor changes, the change takes effect immediately.
16. Changes to These Terms
For material changes to these Terms, we will notify you by email and via an in-app dialog at least 30 days before they take effect. For non-material changes, we will simply update the "Last updated" date.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. Disputes shall be resolved in the courts of the Comarca de Dourados, Mato Grosso do Sul, except as required by mandatory consumer protection laws applicable in your jurisdiction (including the Brazilian Consumer Defense Code).
18. Severability and Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
